Chapter 4 Handling of Complaint Reporting
第二十六條各級行政機(jī)關(guān)根據(jù)職責(zé)權(quán)限和信訪事項性質(zhì),按照下列方式辦理信訪事項:
Article 26 The following procedures shall be applied by administrative authorities at various levels in handling complaint reporting according to their functions and powers, and in consideration of the nature of the complaint reporting:
(一)對本機(jī)關(guān)依法應(yīng)當(dāng)或者有權(quán)做出處理決定的信訪事項,應(yīng)當(dāng)直接辦理;
(1) direct handling of those matters which should be handled by the relevant administrative authority or are within the authority of the administrative authority to handle according to law;
(二)對依法應(yīng)當(dāng)由上級行政機(jī)關(guān)做出處理決定的信訪事項,應(yīng)當(dāng)及時報送上級行政機(jī)關(guān);
(2) reporting the matter in due course to a higher administrative authority if it should be handled by that administrative authority according to law; and
(三)對依法應(yīng)當(dāng)由其他行政機(jī)關(guān)做出處理決定的信訪事項,應(yīng)當(dāng)及時轉(zhuǎn)送、轉(zhuǎn)交其他行政機(jī)關(guān)辦理。
(3) Transferring the matter timely to another administrative authority if it should be handled by that administrative authority according to law.
第二十七條各級行政機(jī)關(guān)及其工作人員辦理信訪事項,應(yīng)當(dāng)恪盡職守,秉公辦事,查清事實,分清責(zé)任,正確疏導(dǎo),及時、恰當(dāng)、正確處理,不得推諉、敷衍、拖延。
Article 27 Administrative authorities at various levels and their staffs shall be diligently perform their duties, and impartial in handling matters, obtain the truth, identify liabilities, make correct persuasions and duly, properly and correctly resolve matters. They shall not shift responsibilities to others or conduct their work in a delayed or perfunctory manner.第二十八條辦理信訪的工作人員與信訪事項或者信訪人有直接利害關(guān)系的,應(yīng)當(dāng)回避。
Article 28 If a staff member engaged in handling complaint reporting has direct interests with a complaint reporting or concerning the complainant, he shall excuse himself from the handling of the complaint reporting.
第二十九條行政機(jī)關(guān)及其工作人員在辦理信訪事項過程中,不得將檢舉、揭發(fā)、控告材料及有關(guān)情況透露或者轉(zhuǎn)送給被檢舉、揭發(fā)、控告的人員和單位。Article 29 In handling complaint reporting matters, administrative authorities and their staffs shall not release or transfer any material concerning accusations, expositions or charges to the person or organization accused, exposed or charged.
任何組織和個人不得壓制、打擊報復(fù)、迫害信訪人。 No organization or individual shall suppress, retaliate against or persecute a complainant.
第三十條各級行政機(jī)關(guān)直接辦理的信訪事項應(yīng)當(dāng)在30日內(nèi)辦理完畢,并視情況將辦理結(jié)果答復(fù)信訪人; Article 30 Within 30 days, administrative authorities at various levels shall resolve complaint reporting matters within its jurisdiction, and shall advise the concerned complainant of the result of the decision according to the circumstances.
情況復(fù)雜的,時限可以適當(dāng)延長。Under complicated circumstances, the prescribed period may be extended appropriately.
第三十一條各級行政機(jī)關(guān)對交辦的信訪事項,應(yīng)當(dāng)自收到之日起90日內(nèi)辦結(jié),并將辦理結(jié)果報告交辦機(jī)關(guān); Article 31 Within 90 days, administrative authorities at various levels shall resolve complaint reporting matters which have been assigned to them and shall advise the administrative authority that originally assigned the matter of the result of the decision.
不能按期辦結(jié)的,應(yīng)當(dāng)向交辦機(jī)關(guān)說明情況。If the matter cannot be resolved within the prescribed period, an explanation should be presented to the administrative authority which originally made the assignment.
交辦機(jī)關(guān)認(rèn)為對交辦的信訪事項處理不當(dāng)?shù)?,可以要求辦理機(jī)關(guān)重新處理。 If the administrative authority which assigned the matter considers the decision of the matter is not proper, it may require re-handling by the administrative authority which handled the matter.
第三十二條有關(guān)行政機(jī)關(guān)對轉(zhuǎn)辦的信訪事項,應(yīng)當(dāng)自收到之日起90日內(nèi)辦結(jié),并可以視情況向轉(zhuǎn)辦機(jī)關(guān)回復(fù)辦理結(jié)果。Article 32 Within 90 days, the relevant administrative authority shall the complaint reporting matter which has been transferred to it and shall advise the administrative authority that originally transferred the result according to the circumstances.
第三十三條信訪人和有關(guān)單位對行政機(jī)關(guān)做出的信訪事項處理決定,應(yīng)當(dāng)遵守、執(zhí)行; Article 33 The complainant or the relevant units shall comply with and execute the decision that has been made by the relevant administrative authority.
對處理決定不服的,除依照法律、行政法規(guī)的規(guī)定申請復(fù)議或者提起行政訴訟的外,可以自收到處理決定書之日30日內(nèi)請求原辦理機(jī)關(guān)復(fù)查。 If, within 30 days from receipt of the written decision, they are unsatisfied with the decision, they may request the original decision making administrative authority to review the decision unless an administrative reconsideration or an administrative lawsuit are provided for pursuant to laws or administrative regulations.
原辦理機(jī)關(guān)應(yīng)當(dāng)自收到復(fù)查請求之日起30日內(nèi)提出復(fù)查意見,并予以答復(fù)。Within 30 days from receipt of the request for review of the decision The original administrative authority shall render its opinion and issue a reply.
第三十四條對原辦理機(jī)關(guān)的處理決定或者復(fù)查意見不服的,信訪人可以自收到處理決定書或者復(fù)查意見書之日起30日內(nèi)請求上一級行政機(jī)關(guān)復(fù)查,上一級行政機(jī)關(guān)應(yīng)自收到復(fù)查請求之日起30日內(nèi)提出復(fù)查意見。Article 34 If the complainant is unsatisfied with the decision or opinion upon review by the original administrative authority, he may appeal to the administrative authority at the next higher level for a review within 30 days from receipt of the written decision or the written opinions after review, and the latter shall propose opinions thereon within 30 days from receipt of the application for review.
經(jīng)復(fù)查,信訪事項處理決定正確的,不再處理。 The matter shall not be dealt with if the original decision or opinion is correct.
第三十五條行政機(jī)關(guān)發(fā)現(xiàn)本機(jī)關(guān)對信訪事項的處理、復(fù)查確有錯誤的,應(yīng)當(dāng)重新處理。Article 35 Upon discovery of its own mistaken decision or review opinion on a complaint reporting matter, an administrative authority shall make necessary corrections.
上級行政機(jī)關(guān)發(fā)現(xiàn)下級行政機(jī)關(guān)對信訪事項的處理、復(fù)查確有錯誤的,有權(quán)直接處理或者責(zé)成下級行政機(jī)關(guān)重新處理。 Upon discovery of a mistake made by a lower administrative authority erred in the decision or review of a complaint reporting matter, a higher administrative authority shall have the power to take over the matter for decision or to instruct the lower administrative authority to make a new decision.
第三十六條各級行政機(jī)關(guān)應(yīng)當(dāng)及時分析信訪事項反映的社會情況和人民群眾的愿望,提出建議,改進(jìn)工作。 Article 36 Administrative authorities at various levels shall earnestly study the social implications and the wishes of the masses reflected in a complaint reporting and shall come up with suggestions for the improvement of work accordingly.
Chapter 4 Handling of Complaint Reporting
第二十六條各級行政機(jī)關(guān)根據(jù)職責(zé)權(quán)限和信訪事項性質(zhì),按照下列方式辦理信訪事項:
